These Terms of Use ("Terms") are a legal agreement between you and DaDa Labs Pty Ltd (ACN 700 556 734) ("DaDa", "we", "us"). They govern your use of the DaDa mobile app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
Your privacy is covered by our Privacy Policy, which forms part of these Terms.
1.1 You must be 18 years or older and have an Australian mobile number to use DaDa. By signing up you confirm you meet these requirements.
1.2 One account per person. You are responsible for activity under your account and for keeping your login secure. Tell us immediately if you suspect unauthorised access.
1.3 You must give accurate information (including your date of birth and any profile details you choose to add) and keep it current. You accept these Terms and our Privacy Policy by actively selecting a checkbox at sign-up confirming that you have read and agree to them; we record your account identifier, the date and time of your acceptance, and the version of the Terms and Privacy Policy you accepted.
DaDa lets you join topic-based communities you're eligible for, post content, reply, vote in polls, and engage with advertising and prize promotions. The Service is free to users; we're funded by advertising.
We may change, suspend, or discontinue features at any time. We'll try to give notice of material changes, but we're not obliged to maintain any particular feature.
3.1 You own your content. You keep ownership of the posts, images, audio, video, documents and other material you create ("Your Content").
3.2 Licence to us. To operate the Service, you grant DaDa a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (e.g. compress/resize for delivery), publish and display Your Content for the purpose of operating, promoting and improving the Service. This licence lasts while Your Content is on the Service and for a reasonable period afterward for backups and the de-identified retention described in the Privacy Policy.
3.3 Your responsibility and warranty. You are solely responsible for Your Content. You warrant that you own it or have the rights to post it, and that it does not infringe anyone's rights or break any law.
3.4 Other users' content. Content posted by other users is theirs, not ours. We don't endorse it and aren't responsible for it. It may be inaccurate, offensive, or unlawful.
You agree not to post content or behave in a way that:
is unlawful, defamatory, harassing, threatening, hateful, or incites violence;
is sexually explicit, pornographic, or child sexual abuse material (zero tolerance);
infringes intellectual property, privacy, or other rights;
is spam, a scam, deceptive, or covert advertising;
promotes self-harm, or dangerous, or seriously harmful activity;
impersonates another person or misrepresents your affiliation;
contains malware, or attempts to hack, disrupt, scrape, or reverse-engineer the Service;
harvests other users' data, or uses the Service to break any law.
We have a zero-tolerance policy for objectionable content and abusive behaviour. We may remove content and suspend or terminate accounts that breach this section.
5.1 You can report content or users, and block users, in the app.
5.2 We operate moderation tools including reports, per-community suspension and blocking, a platform-wide trust/misconduct system, and content removal by moderators.
5.3 We aim to review reports of objectionable content and act promptly — removing content and/or ejecting the user where appropriate. We may act on breaches at our discretion, including removing content, suspending or terminating accounts, and reporting unlawful content to authorities.
If you believe content on DaDa infringes your copyright or other rights, contact us at support@dadalabs.net with enough detail to identify the content and your rights. We will review and remove infringing content where appropriate, and may terminate repeat infringers.
7.1 The Service shows advertising from merchants and runs prize promotions. Each promotion is governed by its own promotion terms, shown at the time.
7.2 Prizes are supplied and honoured by the merchant, not DaDa. Prize vouchers are single-use, have no cash value, are not transferable or redeemable for cash, and may expire. We're not responsible if a merchant fails to honour a prize, but we'll reasonably assist.
7.3 Reward points and trust levels are a virtual, in-app measure only. They have no monetary value, cannot be bought, sold, transferred, or redeemed for cash, and we may adjust or reset them.
8.1 By you — delete your account any time in the app.
8.2 By us — we may suspend or terminate your access if you breach these Terms, engage in unlawful conduct, or create a genuine and material risk to the safety of other users, DaDa, or the operation of the Service. Where practical and lawful we'll give notice and a reason; for serious breaches (e.g. illegal content) we may act immediately.
8.3 On termination, your licence to use the Service ends. The Privacy Policy governs what happens to your data.
9.1 Consumer guarantees. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded (consumer guarantees). Where we're permitted to limit liability, we do.
9.2 The Service is provided "as is". To the extent permitted by law, we exclude implied warranties and are not liable for indirect or consequential loss, loss of data, or loss caused by other users' content or by merchants.
9.3 Where liability can't be excluded but can be limited, our liability is limited to (at our option) re-supplying the service or paying the cost of doing so. As the Service is free, our aggregate liability to you is limited to AUD $100.
We may update these Terms. For material changes (including changes to liability, dispute resolution, or how we handle your data), we will require you to actively re-accept the updated Terms before you can continue using the Service. For other minor updates that do not reduce your rights or increase your obligations under these Terms (for example, formatting, contact details, or correcting an error), we will give reasonable notice (e.g. in-app) and your continued use of the Service after the change takes effect means you accept it.
11.1 Governing law — these Terms are governed by the laws of Victoria, Australia, and you submit to the courts of that jurisdiction.
11.2 If any provision is unenforceable, the rest continue.
11.3 These Terms (with the Privacy Policy and any promotion terms) are the entire agreement between us.
